I Received a Ticket for Using HOV with My 17 Month Old……

Question:

I received a ticket for using HOV with my 17 month old. I thought it was legal with any 2 living/pre infant persons in the car. Should I fight it? The cop told me my son didn’t count as a passenger that it has to be another licensed driver to use the HOV.

Answer:

I believe the officer is simply wrong in this case. It would be interesting to see the government argue that infants aren’t really people and shouldn’t count! If you have the time and money to fight the charge – hiring an attorney will be the best way to win the case. Good Luck!!!
